Personal data

Personal data is information that relates to an identified or identifiable natural person (for example, name, address or e-mail address). As a matter of principle, we process personal data of our users only insofar as this is necessary for the provision of a functional website as well as our services. The legal basis for this is Art. 6 para. 1 p. 1 lit. f) or b) DS-GVO. The processing of personal data of our users that goes beyond this regularly takes place after explicit consent. The legal basis for this is Art. 6 para. 1 p. 1 lit. a) DS-GVO. In exceptional cases, we also process data if this is permitted by legal regulations, e.g. via the legal bases of Art. 6 (1) p. 1 lit. c), d), e) and f) DS-GVO.

Storage period/deletion

Personal data will be deleted as soon as the purpose of storage ceases to apply. As long as legal storage obligations, such as tax and commercial law regulations, prevent the deletion of your personal data, we restrict the processing of your data for this period. As soon as these legally stipulated storage periods expire, the data will be deleted.

Direct collection of data and transfer to third parties

We usually collect personal data directly from you as the data subject by providing it to us yourself. In the event that we process data that has not been collected from you ourselves, we will inform you of this fact. In addition, we do not transfer any data to third parties unless you have given us your express consent to do so. In exceptional cases, we may involve service providers who may also come into contact with personal data. If this is the case, we will ensure that these processors are properly selected and, in accordance with Art. 28 DS-GVO, undertake on their part to comply with data protection laws. If we make use of commissioned service providers for individual functions of our offer or would like to use your data for promotional purposes, we will inform you in detail about the respective processes below.

Provision of our statutory / business services

If we collect and process data in order to perform our statutory and/or business services, the legal basis for this processing is Art. 6 (1) p. 1 lit. b) DS-GVO. Within the scope of our statutory and/or business tasks and contractual obligations, we process data of members, interested parties, participants, customers, visitors, applicants as well as partners. As a rule, the data processing thereby relates to the following categories:

  • Personal and master data (e.g.: name, address, date of birth),
  • Contact data (e.g.: telephone number and e-mail address),
  • contract data (e.g. date and content of the contract) and
  • Payment data (e.g.: bank details), if these are required for the contractual relationship.

For data processing that goes beyond the fulfillment of statutory and/or business tasks or the initiation and execution of contracts, we refer to the protection of legitimate interests pursuant to Art. 6 (1) p. 1 lit. f) DS-GVO, unless we have obtained express consent for this purpose from you (Art. 6 (1) p. 1 lit. a) DS-GVO). We will obtain such consent in particular if the data processing concerns special categories of personal data (e.g.: health data). If consent concerns the data of a child, the consent of the legal guardian will be obtained. You can revoke any consent to the processing of your data at any time with effect for the future.

Your rights as a data subject

You have the following rights regarding the personal data concerning you:

  • the right to free information about your stored data,
  • the right to rectification,
  • the right to deletion,
  • the right to restriction of processing,
  • the right to data portability.

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you. Such right of objection concerns cases of data processing according to Art. 6 para. 1 p. 1 lit. e) as well as f) DS-GVO. An objection at any time is also possible against profiling as well as against data processing for direct advertising.

In addition, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of personal data concerning you violates the General Data Protection Regulation.

If processing is based on your consent, you can revoke this at any time with effect for the future.

To assert your rights or if you have any questions, you can contact the data protection officer of the Bundesverband Berufsbildung International e.V. at the following address: Dr. Helmut Riethmüller, Charlottenstr. 2, 10969 Berlin, Germany.

No automated decision-making

Automated decision-making including profiling pursuant to Art. 22 (1) and (4) DS-GVO does not take place.

Contacting

When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, name and telephone number, if applicable) will be stored by us in order to answer your questions. We delete the data accruing in this context after the storage is no longer necessary or restrict the processing if there are legal retention obligations. Your personal data is protected by technical and organizational measures during collection, storage and processing in such a way that it is not accessible to third parties. However, we would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. Therefore, we cannot guarantee complete data security when communicating by e-mail, so we recommend that you send information requiring a high level of confidentiality by post.

Encryption

For reasons of security and to protect the transmission of confidential content, such as requests that you send to us as the site operator, this site uses a so-called TLS encryption. You can recognize such an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the closed "lock" symbol in your browser line. If this TLS encryption is activated, the data that you transmit to us can generally not be read by unauthorized third parties during transmission to us.

Collection of personal data when visiting our website

When using the website for information purposes only, i.e. if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f) DS-GVO).

  • IP address
  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Website from which the request comes
  • Browser
  • Operating system and its interface
  • Language and version of the browser software.

Below we present how we collect information during your visit to our website and how it is used.

Cookies

In addition to the previously mentioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your computer, cell phone or other device in the browser you are using and which provide the party setting the cookie (in this case, us) with certain information. Cookies cannot execute programs or transmit viruses to your computer.

This website uses transient and persistent cookies, the scope and functionality of which are explained below:

Transient cookies are automatically deleted when you close the browser. These include, in particular, session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the same session. This allows your device to be recognized when you return to our website. The session cookies are deleted when you close the browser. These transient cookies are necessary to provide you with the website and to deliver the content you have accessed. Some of these cookies are also used to enable certain functionalities of the website, such as saving your settings on cookies on our website, and thus make your visit more comfortable. The use of these cookies is based on Section 25 (2) No. 2 TTDSG.

Persistent cookies, on the other hand, are deleted automatically after a specified duration, which may differ depending on the cookie.
Insofar as our cookies are technically necessary for the provision of the website and its basic functions, their storage and access to these cookies is based on § 25 para. 2 no. 2 TTDSG. Any subsequent data processing is based on Art. 6 para. 1 p. 1 lit. f) DS-GVO, whereby our legitimate interest is to provide visitors with a properly functioning website and to make the use of the website as efficient as possible. The user data collected by these technically necessary cookies are not used to create user profiles.

Apart from that, cookies are generally only used with your consent on the basis of Section 25 (1) TTDSG. The consent can be revoked at any time with effect for the future. Further information on the functions of these cookies can be found in the following explanations of this privacy policy (in each case for the function or service that uses such optional cookies).
You can manage your consent to the use of optional cookies in the privacy settings. In addition, you have control over the setting of any cookies via the settings in your browser. You can delete all cookies in your browser settings at any time. You can also configure your browser settings according to your wishes, for example, to prevent so-called third-party cookies that are set by third-party providers, or to generally prevent all cookies, or to only allow cookies individually. Please note that you may not be able to use all functions of this website if you prevent or restrict cookies for the website.

Matomo

We have embedded Matomo, a service provided by InnoCraft Limited, 150 Willis Street, Wellington 6011, New Zealand, on this website ("Matomo"). Matomo is an open source software tool for analyzing how visitors use our website. We use the data and information obtained to, among other things, evaluate the use of this website and to compile online reports showing activity on our pages. For these purposes, the service uses cookies to record, among other things, a pseudonymous identification number (so-called user ID) assigned to your browser, the third-party website from which you accessed our site (so-called referrer URL), information on the time and place of access, which parts of our website you access, and how often and for how long you viewed a particular part of our website. Your IP address is automatically shortened and therefore only anonymized by Matomo. With the evaluated data and online reports we gain knowledge about how our website is used. This enables us to adapt and improve the website according to the actual use by visitors and user needs.

Matomo sets cookies on your device for the purposes described above. The cookies remain stored in your browser for a maximum of 1 year. Each time you visit our website, the aforementioned data is transmitted to us. This personal data is stored and processed by us. We do not pass on this personal data to third parties.

Matomo is only hosted on a server of our sub-service provider Hetzner Online GmbH, Industriestr. 25, 91719 Gunzenhausen (so-called "Matomo On-Premise" solution), which is operated by our service provider rms GmbH, Königstr. 43b, 70173 Stuttgart ("rms"). Therefore, the aforementioned data and also the reports are stored and processed exclusively on this server. The stored raw data is deleted once a year, at the latest one year after it has been collected. Since we have concluded a contract on order processing with rms, the data transfer to this service provider is based on Art. 28 DS-GVO. The data is processed by rms exclusively on our instructions and on our behalf.

You can exclude data processing by Matomo from the outset by activating a so-called "Do Not Track" setting in your browser, which you can use to indicate that you do not wish user profiles to be created about you. Matomo does not collect any data from you if you have activated this "Do Not Track" setting.

You can also prevent the setting of cookies by our website at any time by means of an appropriate setting of the browser used and thus permanently object to the setting of cookies. Such a setting of the browser used would also prevent Matomo from setting cookies on your device. In addition, a cookie already set by Matomo can be deleted at any time via an Internet browser or other software programs.

Further information and the applicable privacy policy of Matomo can be found at matomo.org/privacy/.

We only use Matomo with your consent. The legal basis for the use of the Matomo cookies is therefore Section 25 (1) TTDSG. The legal basis for data processing in connection with Matomo is Art. 6 para. 1 p. 1 lit. a) DS-GVO. You can freely revoke your consent to the use of cookies and/or the processing of your data at any time with effect for the future by deselecting the relevant check boxes in the privacy settings to adjust your consent ("Statistics" category).

Supplements to this data protection statement

Technical developments or changes in our business operations make it necessary to make adjustments to our privacy policy from time to time. We reserve the right to make changes to this statement and will inform you about the changes at this point.
